This Site is operated by Yanga Ventures, doing business as Kmusta (“Kmusta”, “we”, “us”, “our”). By accessing or using this Site, you agree to these Terms of Service. If you do not agree, do not use this Site.

1. Use of Site

1.1 Permitted Use

You may use this Site to

• Learn about Kmusta’s mobile coffee cart, menu, and event packages

• Review package and pricing information

• Submit an event inquiry or check a date

• Access publicly available content

1.2 Prohibited Use

You may not:

• Use this Site for any unlawful purpose or in violation of these Terms

• Attempt to gain unauthorized access to Site systems, accounts, or networks

• Transmit viruses, malware, or other harmful code

• Scrape, copy, or reproduce Site content for commercial purposes without written permission

• Impersonate Kmusta or misrepresent your affiliation with Kmusta

• Use automated tools (bots, scrapers) to access the Site without prior written consent

1.3 Account Registration

If the Site offers account creation in the future, you are responsible for:

• Maintaining the confidentiality of your account credentials

• All activities that occur under your account

• Notifying Kmusta immediately of any unauthorized access

2. Intellectual Property

2.1 Ownership

All content on this Site, including text, graphics, logos, images, videos, code, and software (“Site Content”), is the property of Kmusta Inc. or its licensors and is protected by Canadian and international copyright, trademark, and other intellectual property laws.

2.2 Limited License

Kmusta grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Site and Site Content for personal, non-commercial purposes. You may not:

• Modify, copy, distribute, transmit, display, reproduce, or create derivative works from Site Content

• Use Site Content for commercial purposes without written permission

• Remove copyright, trademark, or other proprietary notices from Site Content

2.3 Trademarks

“Kmusta” and related logos are trademarks of Yanga Ventures, doing business as Kmusta. You may not use these trademarks without prior written consent.

3. Disclaimers and Limitations

3.1 No Warranties

THE SITE AND ALL SITE CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Accuracy: Information on the Site (including pricing, package details, and service descriptions) is for general informational purposes only and may not be accurate, complete, or current.

• Availability: We do not guarantee the Site will be uninterrupted, secure, or error-free.

• Fitness for Purpose: We make no warranty that the Site or its content will meet your requirements or be suitable for any particular purpose.

3.2 Bookings, Quotes, Deposits, and Cancellations

Inquiries are not bookings

Submitting an inquiry through this Site (including the “Check your date” form) is a request for availability, not a confirmed booking. A booking is confirmed only when we confirm it in writing and any required deposit has been received.

Quotes

Quotes are prepared from the details you provide — date, guest count, venue, and service hours — and may be revised if those details change. Each quote states its own validity period.

Deposits and cancellations

Deposit amounts, payment schedules, and cancellation or rescheduling terms are set out in your written quote or event agreement, which governs your booking.

Service area

We serve events across Ottawa-Gatineau (the National Capital Region). Events outside this area may be possible with travel arrangements agreed in advance.

Weather and venue conditions

Outdoor service requires suitable conditions, including shelter and access to power where specified in your event agreement. If severe weather, venue restrictions, or safety concerns prevent us from serving as planned, we will work with you in good faith to relocate the cart, adjust service, or reschedule in accordance with your event agreement.

3.3 No Professional Advice

Content on this Site does not constitute legal, financial, tax, or professional advice. You should consult qualified professionals before making business decisions based on Site content.

3.4 External Links

This Site may contain links to third-party websites. We do not endorse, control, or assume responsibility for the content, privacy practices, or availability of external sites. Use of external links is at your own risk.

4. Limitation of Liability

To the maximum extent permitted by law:

Yanga Ventures, doing business as Kmusta, and its officers, employees, contractors, and affiliates are not liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from:

• Your use or inability to use this Site

• Your reliance on information or pricing on this Site

• Errors, omissions, or inaccuracies in Site content

• Unauthorized access to or alteration of your data

• Third-party conduct or content on or linked from the Site

You agree to indemnify, defend, and hold harmless Yanga Ventures, doing business as Kmusta, and its officers, employees, and contractors from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising from:

• Your use of the Site

• Your violation of these Terms

• Your violation of any third-party rights, including intellectual property rights

• Your violation of applicable laws or regulations

6. Privacy and Data Collection

Your use of this Site is also governed by our Privacy Policy. By using this Site, you consent to the collection, use, and disclosure of your information as described in the Privacy Policy.

7. Changes to Terms

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada, without regard to conflict of law principles.

9.2 Jurisdiction

You agree to submit to the exclusive jurisdiction of the courts located in the Province of Ontario for the resolution of any dispute arising from these Terms or your use of this Site.

9.3 Dispute Resolution

Before initiating legal action, both parties agree to attempt to resolve disputes informally by contacting Kmusta at hello@kmusta.ca.

10. Severability

If any provision of these Terms is found unenforceable by a court of competent jurisdiction, the remaining provisions remain in full force and effect.
